Art. ISubject of the contract
This contract governs the delivery of a generative artistic experience based on the acquisition of the Client's electroencephalographic (EEG) signals, aimed at creating a unique and unrepeatable visual artwork. The Atelier undertakes to provide the equipment, the immersive environment and the resulting digital artwork.
Art. IINature of the experience
The experience takes place at the Atelier's studio and lasts approximately 45 minutes. During the session, a non-invasive EEG device records the Client's brain activity, translating it in real time into generative graphic strokes, colours and dynamics projected onto the digital canvas. The resulting artwork reflects the Client's unique neural signature at the moment of the session.
Art. IIINeural data processing
EEG data is processed exclusively in anonymous form and in real time for the sole purpose of generation. It is not stored, transferred to third parties, or used for any purpose other than producing the artwork. Processing takes place in accordance with Regulation (EU) 2016/679 (GDPR). At the end of the session, all raw data is irreversibly erased.
Art. IVIntellectual property of the artwork
The generated artwork is the property of the Client, who acquires full ownership and the right to reproduce it for personal use. The Atelier retains the moral right of authorship and the right to cite the artwork, in anonymous form and at reduced resolution, within its own portfolio and for exhibition purposes.
Art. VService level agreement (SLA)
The Atelier guarantees the following response times in the event of technical anomalies during or after the session:

Fee and payment terms

Single payment upon signing this contract, before the session begins.
Payment is made by bank transfer, credit card, or cash within the limits set by law. Delivery of the digital artwork is conditional upon full payment.
Contraindications and liability
The experience is not recommended for persons affected by photosensitive epilepsy, carriers of deep brain stimulators, or those in advanced pregnancy. The Client declares that they have been adequately informed and releases the Atelier from any liability arising from omitted or false declarations regarding their state of health.
The Parties undertake to keep the content of this contract and any information exchanged confidential, save for legal obligations. The artwork may be publicly disclosed only with the Client's prior written consent.
Any dispute arising from this contract shall be exclusively referred to the Court of Milan, subject to any mandatory contrary provisions of law applicable to consumers.
The Parties declare that they have read, understood and fully accepted the terms above. This contract becomes binding upon signature.

Specific approval — arts. 1341 and 1342 Italian Civil Code
Pursuant to and for the purposes of arts. 1341 and 1342 of the Italian Civil Code, the Client specifically approves the clauses set out in articles: III (Neural data processing), V (SLA), VII (Contraindications), IX (Governing court).
